Please read these Terms and Conditions carefully, as they contain important information. In using our website www.uniteyql.com, you are deemed to have read and agreed to the following Terms and Conditions:

 

The following terminology applies to these Terms and Conditions, Privacy Statement, Disclaimer Notice and any or all Agreements: “Client,” “Member,” “Guest,” “You,” and “Your” refers to you, the person accessing our website and accepting our Company’s terms and conditions. “The Company,” “Ourselves,” “We” and “Us” refers to our Company UNITE YQL Inc. “Party,” “Parties,” or “Us,” refers to both the Client and us, either the Client or Ourselves. All terms refer to the offer, acceptance or consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, for the express purpose of meeting the Client’s needs in respect to the Company’s stated services and products. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

 

Our website WWW.UNITEYQL.COM, allows clients to receive information about UNITE YQL as well as reserve, cancel, and pay for services and products offered at our studio. The services offered by UNITE YQL include but are not limited to the
https://www.uniteyql.com website, which is hosted in North America.

 

REGISTRATION

To use our website, you must first complete the registration form. During registration, it is required to give certain information (such as your first and last name, address, phone number and email address). This information is used to contact you about the products/services on our site in which you have expressed interest. At your option, you may also provide demographic information (such as gender or age) about yourself.

 

Registration of minors (ages 15-17) must be completed in person at one of our studios with a parent or legal guardian present.

 

If you are between the ages of 15 and 17, you may register on our website only with the involvement of a parent or guardian as well as a waiver signed in person at the UNITE YQL studio.

 

Your personally identifiable information is kept secure. Only authorized employees, agents, and contractors who have agreed to keep information secure and confidential have access to this information. All emails and newsletters from this site allow you to opt out of future marketing mailings. We use industry-standard efforts to safeguard the confidentiality of your personal  information, including the use of firewalls and secure sockets layer software where appropriate.

 

UNITE YQL reserves the right to refuse, terminate accounts, remove or edit content, or cancel orders in their sole discretion. When you visit UNITE YQL or send emails to us, you are communicating with us electronically, and therefore consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

COOKIES

We use “cookies” on this site. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, you would not have to login a password more than once, thereby saving time while on our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site. Usage of a cookie is in no way linked to any personally identifiable information on our site. Our website is hosted by: www.asmallorange.com which is in Atlanta, Georgia, United States.

 

CANCELLATION & RESERVATION POLICY

To cancel your reservation in a UNITE YQL class you must cancel online via the app or on our website via your account.

 

To unreserve your class WITHOUT PENALTY, you must go online no later than 6 HOURS before your scheduled class, to have your class credit returned to your account.

 

If you do not unreserve your class before the cancellation window (6 HOURS before your scheduled class) or you do not show up for class, class card buyers will forfeit the single class from your class package. Clients with an Unlimited Membership will be charged $12 for any late cancellations (within 6 hours) and will be charged $16 for each “No-show” (you are registered for the class, but did not show up for the scheduled class).

 

You cannot unreserve or late cancel a class through email, voicemail, text message, and/or direct messaging through Facebook or Instagram. YOU MUST UNRESERVE THROUGH THE APP OR YOUR ACCOUNT ON OUR WEBSITE.

 

You are solely responsible for managing your class reservations, waitlists, and cancellations. When you arrive at the studio for class, you are responsible for checking in so that we know you are present. If you are not signed in by 2 minutes before the
scheduled class time, spots will be released to standby guests. As a courtesy to your instructor and your fellow class participants, if you arrive more than more than 1 minute after class begins, you will not be allowed in class.

 

You are solely responsible for managing your reservations and for cancelling classes within the framework of our cancellation policy. If you book multiple classes or are on the waitlist for multiple classes, you are solely responsible for canceling your classes within our cancellation policy. If you reserve a class by accident, or double book a class, or double book yourself on the waitlist, UNITE YQL is not held responsible. Please be aware that we release spots 2 minutes before the start of class to those on standby.

 

CLASS CARDS AND CREDIT CARD INFORMATION

When you buy class credits or packages from UNITE YQL, you agree to our terms and conditions in full. Clients may elect to keep a credit card on file using their UNITE YQL account online. By placing a card on file, the cardholder and account holder permits the UNITE YQL staff to charge the card for any in-studio purchases made by the client unless the client provides an alternate form of payment.

 

UNLIMITED, AUTO RENEW AND CREDIT CARD INFORMATION

When purchasing an unlimited or auto renew pass membership from UNITE YQL, you agree to our terms and conditions in full. Unlimited and auto renew members are required to keep a valid credit card on file using their UNITE YQL account online. By purchasing an unlimited or auto renew pass membership, the card and account holder permits the UNITE YQL staff to charge the card every 30-days for their membership fee and for any in-studio purchases made by the client unless the client provides an alternate form of payment. Unlimited and auto renew passes cannot be used to book a guest and are non-transferable.

 

For auto renew memberships, if your credit card is declined, you have a 1-day grace period to make a payment before we freeze your pass. Auto renew memberships can be cancelled any time after the first 4-month commitment with 30 days’ notice.
Cancellation notice must be provided in-person or via email hello@uniteyql.com.  You cannot provide cancellation notice via Facebook, Text, or Instagram.

 

REFUND POLICY

We do NOT provide refunds on class cards, monthly passes, or auto renew payments. Retail items returned within 7 days of purchase, tags attached, can be exchanged or refunded.

 

HEIGHT REQUIREMENT

Riders must be at least 4’ 11” to take cycle classes at UNITE YQL.

 

BIKE + HOT ROOM CONDITIONS

UNITE YQL is an intense workout. Cycle practices combine rhythm-based choreography, high intensity intervals, and upper body sculpting exercises in class. Our Hot room practices combine low intensity and with high-intensity workouts. Please
consult your doctor before beginning a new exercise regimen. The temperature in the bike room ranges from 19-24 degrees depending on the quantity of guests in the room and outdoor weather conditions. Our hot room is heated up to 33 degrees with 65% humidity. Loud music will be played in class that may contain explicit language.

 

PERSONAL BELONGINGS

You agree that UNITE YQL is in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings. Please leave valuables at home as only a towel and water bottle are permitted in the studio room.

 

WEBSITE DISCLAIMER

The information provided by UNITE YQL (“we”, “us”, or “our” on www.uniteyql.com, the “Site”) and our mobile application is for general information purpose only. All information on the Site and our mobile application is provided in good faith, however we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability or completeness of any information on the Site or our mobile application. UNDER NO CIRCUMSTANCE SHALL WE HAVE LIABILITY TO YOU FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SITE OR OUR MOBILE APPLICATION OR RELIANCE ON ANY INFORMATION PROVIDED ON THE SITE AND OUR MOBILE APPLICATION. YOUR USE ON THE SITE AND OUR MOBILE APPLICATION AND YOUR RELIANCE ON ANY INFORMATION ON THE SITE AND OUR MOBILE APPLICATION IS SOLELY AT YOUR OWN RISK.

 

RESERVATIONS

Classes can be reserved up to 7 days in advance. To reserve your spot, you must first purchase a credit or have a class credit on file in form of a class card or membership. Spots cannot be reserved without payment first.

 

CANCELLATIONS

We value accountability! If you book a spot in a class or waitlist, be sure you can attend class. As a courtesy to our team and community, we charge late cancellation and no- show fees. If you need to cancel your spot or waitlist position, please do so no less than 6 hours if a spot is reserved and as soon as you know you can no longer attend a waitlisted class. All cancellations must happen online. If you late cancel or no-show, you will forfeit the class credit and unlimited members will be charged $12 for late cancels and $16 for a no-show.

 

ARRIVE EARLY

Please arrive 15 minutes before class start. This ensures that we can get you properly set up and provide a proper run down of what to expect in class.

 

CHECK-IN

Be sure to let us know when you arrive to avoid any no show penalties. It is your responsibility to make sure you have notified the proper front-end staff that you have arrived for class.

 

LATE ARRIVALS

Spots will be released to standby guests 2 minutes before class begins. The studio room doors will be closed 1 minute before class start time and late entries more than 1 minute after class start time are not permitted.

 

LEAVING EARLY

We discourage leaving class early and want to hold our community accountable to the class and class length they signed up for as the length of the class is always indicated.

 

WAITLISTS

If a class is full, you can choose to be added to our waitlist. If a spot becomes available, you will be automatically enrolled into class with an email confirmation. You are responsible for your waitlist reservation. If you can no longer attend class, you must
cancel your waitlist spot to avoid any penalties. Please be mindful that waitlists do move, and the chance is strong that you will be added to class.

 

RETURN AND EXCHANGE POLICY

All drop in’s, special rates, class cards, unlimited and auto renew memberships are final sale.  Retail can be exchanged or refunded within 7 days of purchase with tags attached and in unworn condition.

 

PLEASE READ THIS SECTION CAREFULLY SINCE IT LIMITS THE LIABILITY OF UNITE YQL ENTITIES TO YOU.

LIMITATION OF LIABILITY

 

By agreeing to this Agreement, enrolling online, and/or attending classes, events, activities, and other programs of UNITE YQL, whether online or in the UNITE YQL studio or using UNITE YQL equipment, and/or by using the Services, you hereby acknowledge and agree on behalf of yourself, your heirs, personal representatives and/or assigns (collectively, “you” and/or “yourself”), that (a) there are certain inherent risks and dangers in the strenuous nature of the UNITE YQL workout program; (b) you have voluntarily chosen to participate in an intense physical exercise program; (c) you understand that UNITE YQL strongly recommends that you consult with a licensed physician prior to commencing any classes; (d) you have been fully informed of the strenuous nature of this exercise program and the possibility of adverse physiological occurrences including, but not limited to: abnormal blood pressure, fainting, heart attack or death; and (e) you assume all risk for your health and well-being, and fully release and hold harmless for any responsibility, cost or damages of the UNITE YQL Entities, its instructors, members and employees for any injury, harm or loss you may suffer, including death, as a result of participation in any UNITE YQL activities.

We are providing the services, including the site and mobile apps, on an “as is” and “as available” basis, without warranty of any kind, express or implied.  Without limiting the foregoing, UNITE YQL Entities expressly disclaim any and all warranties and conditions of merchantability, title, accuracy, completeness, uninterrupted or error free service, fitness for a particular purpose, quite enjoyment, non infringement, and any warranties arising out of course of dealing or trade usage.

We make no promises with respect to, and expressly disclaim all liability for: (1) products, services, information, programming, and/or anything else provided by a third party that is accessible to you through the Services, Classes & Facilities; or (2) the quality or conduct of any third party you encounter in connection with your use of the Services, Classes & Facilities.

You agree that the maximum extent permitted by law, UNITE YQL entities will not be liable to you under any theory of liability. Without limiting the foregoing, you agree that, to the maximum extent permitted by law, UNITE YQL entities will not be liable for any indirect, incidental, consequential, special or exemplary damages, loss of profits, business interruption, reputation harm, or loss of date (even if foreseeable) arising out of or in any way connected with your use of, or inability to use the Services, Classes and Facilities.

Your sole remedy for dissatisfaction with the Services, Classes and Facilities is to cease use of these services.

Without limiting the foregoing, UNITE YQL entities’ maximum aggregate liability to you for losses or damages that you suffer in connection with the Services, Classes and Facilities is limited to the amount paid to us in connection with the services in the twelve (12) months prior to the action giving rise to liability.

 

RELEASE AND INDEMNITY AGREEMENT

In consideration for participating or engaging in exercise activities, services, classes, events, and other programs and using the premises, facilities and equipment (individually and/or collectively, the “Classes and Facilities”) of UNITE YQL Inc (“UNITE”), you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Classes and Facilities.
You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You understand and acknowledge that fitness or exercise activities, services and/or use of equipment have inherent dangers that no amount of
care, caution, instruction or expertise can eliminate. You understand that the risks associated with your participation in strenuous exercise include but are not limited to, abnormal blood pressure and heart rate, fainting, heart attack and death. You understand that there are also unforeseeable accidents, which may occur, and you assume all risks associated with such accidents. You agree that it is possible that the equipment being used might malfunction, be defective, and/or fail. You understand that UNITE has the music playing at very high levels and at times reaching over 100 DB and you hold UNITE harmless and assume all risks. UNITE also always provides and makes available ear plugs.

 

At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by staff. If in the subjective opinion of the UNITE staff, you would be at physical risk participating in UNITE Classes, you
understand and agree that you may be denied access to the Classes and Facilities until you furnish UNITE with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing UNITE’s concerns and stating that those concerns are unfounded.

 

In consideration of being allowed to participate in and access the Classes and Facilities, you hereby RELEASE, WAIVE, DISCHARGE and HOLD HARMLESS UNITE YQL INC (UNITE), its agents, officers, shareholders, directors, employees, contractors, volunteers, participants, exercise equipment builders and installers, exercise equipment designers, exercise equipment manufacturers, lessors, insurers and all other persons or entities acting in any capacity on their behalf from any and all liability, claims, actions or losses from bodily injury, property damages, wrongful death, loss of service, demands or any other causes of action, without limitation, that you may hereafter have arising out of your participation in fitness or exercise activities, services, and/or use of equipment including, but not limited to, LOSSES CAUSED BY THE NEGLIGENCE of the RELEASEES.

 

In consideration of taking part in UNITE classes and activities, you also represent that you (a) have no medical or physical condition that would prevent you from properly using any of UNITE’s Classes and Facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in using UNITE’s Classes and Facilities and should not be participating in any Classes.

 

If you are enrolling a minor (an individual under 18 years of age), the above release applies equally to the minor.  No one under 15 years of age may participate.  A minor 15-17 years of age may participate only with a parent or legal guardian present.

 

Personal Belongings: You agree that we are in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings.

 

BY PROCEEDING, I AGREE THAT I HAVE READ THIS ACKNOWLEDGEMENT OF RISK, RELEASE OF LIABILITY AND WAIVER OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP
SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. I ACKNOWLEDGE THAT I AM AGREEING TO THIS AGREEMENT FREELY AND VOLUNTARILY AND INTEND BY MY PROCEEDINGS TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
